A grievance shall be defined as any problem involving terminations, employee discipline or workplace safety, an employee’s wages, hours, or conditions of employment or the interpretation, meaning or application of Board Policies and Administrative Rules, but only as they (the Policies and Administrative Rules) may relate to an employee’s wages, hours, or conditions of employment. A grievant is defined as an employee or group of employees. “Days”, for purposes of this article shall be employee workdays.
1. Grievance(s) shall be processed in accordance with the following:
Step 1: The grievant and the District Administrator/Principal shall make a concerted and earnest effort to resolve the matter informally.
Step 2: The grievant shall submit the grievance in writing directly to the District Administrator/Principal within twenty (20) workdays after the grievant knew or should have known of the occurrence giving rise to the grievance. The Administrator/Principal shall give his/her written answer within five (5) workdays of the date the grievance was presented to him/her in writing.
Step 3: When not settled in Step 2, the grievant may within ten (10) workdays submit the matter in writing to an impartial Hearing Officer appointed by the Board of Education. The Hearing Officer shall give his/her written answer within twenty (20) workdays of the date the grievance was presented to him/her in writing. Any costs for the Hearing Officer shall be shared equally by the grievant and the District.
Step 4: Either party, the grievant or the administrative representative, may within ten (10) workdays submit the matter in writing to the Board. The Board or Board designated Committee shall schedule a hearing within twenty (20) workdays or at their next regularly scheduled meeting. Within ten (10) workdays of the hearing, the Board shall issue its written decision. The Board’s decision shall be final.
2. Employees must follow each of the foregoing steps in the processing of a grievance unless specific time limits are extended by mutual written, signed, and dated consent statements. Grievances not processed to the next step within the prescribed time limits shall be considered dropped.
3. The written grievance shall give a clear and concise statement of the alleged infraction including the facts upon which the grievance is based, the issue involved, the specific Board Policy or Administrative Rule alleged to have been violated, and the relief sought.
